RESOLUTION NO. RS2002-1065

A resolution authorizing the Metropolitan Department of Law to compromise and settle twenty (20) claims against The Metropolitan Government of Nashville and Davidson County arising from the Blue Hole Road water main break in the total amount of $50,000 and directing that this amount be paid from the Self-Insured Liability Fund.

Whereas, on May 25, 2001, the Department of Law received twenty (20) claims listed in Attachment A for water damages resulting from the break of the Blue Hole Road water main maintained by the Metropolitan Department of Water Services; and

Whereas, these twenty (20) claims exceeded the Metropolitan Government's fifty thousand dollar ($50,000) property damage limit of liability under the Tennessee Tort Liability Act; and

Whereas, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and recommends that these claims be compromised and settled and that this amount be paid from the Self-Insured Liability Fund.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the twenty (20) claims as set out in Attachment A in the total amount of fifty thousand dollars ($50,000) and that said amount should be paid from the Self-Insured Liability Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
