RESOLUTION NO. RS2002-952

A resolution requesting the Metropolitan Planning Commission to revise its subdivision regulations relative to mandatory sidewalk construction.


WHEREAS, the Metropolitan Planning Commission apparently has subdivision regulations which require construction of sidewalks even when one lot is sub-divided, although the sidewalk does not connect with any existing sidewalks; and

WHEREAS, construction of sidewalks should be based upon some plan for providing of pedestrian access in a thought-out and convenient manner; and

WHEREAS, it is fitting and proper that the Metropolitan Planning Commission not require sidewalks to be constructed which do not provide access to any facility or other sidewalks.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. The Metropolitan County Council hereby goes on record as requesting the Metropolitan Planning Commission to revise its subdivision regulations relative to mandatory sidewalk construction.

SECTION 2. That the Metropolitan Clerk is directed to send a certified copy of this resolution to the Executive Director and members of the Metropolitan Planning Commission.

SECTION 3. That the Executive Director and members of the Metro Planning Commission are further requested to inform The Metropolitan Council of the feasibility and/or the actions taken in compliance with the request contained in Section 1 hereof, not later than sixty (60) days after the adoption of this Resolution.

SECTION 4. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
