ORDINANCE NO. BL2002-1046
An ordinance approving an agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation and the Tennessee Department of Transportation, accepting a proposed donation from Greenways for Nashville in the amount of $95,000, appropriating the sum of $164,800 for work relating to a segment of the Whites Creek Greenway project from Richard T. Hartman Park to Clarksville Highway.
Whereas, pursuant to the terms of the contract (the "Contract") attached to this ordinance as Exhibit A hereto, the Tennessee Department of Transporation and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation, propose to share in the cost of development of a portion of the Whites Creek Greenway (the "Project"); and
Whereas, the total cost of the Project is expected to be $824,000, of which the Metropolitan Government's share will be $164,800; and
Whereas, in accorandance with the letter of commitment attached to this ordinance as Exhibit B, funds in the amount of $95,000 will be contributed as part of the Metropolitan Government's share of Project costs by Greenways for Nashville; and
Whereas, the funds comprising the Metropolitan Government's $164,800 contribution to the Project have been appropriated and are to be derived as follows:

Whereas, approval of the Contract will benefit the citizens of Davidson County by enhancing the quality and availability of recreational opportunities in Davidson County.
Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:
Section 1: The Contract is hereby approved and the proposed contribution to the Project from Greenways for Nashville is hereby accepted.
Section 2: Any amendments, renewals or extension of the terms of the Agreement must be approved by resolution of the Metropolitan Council.
Section 3: This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
