An ordinance approving an agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation and the Tennessee Department of Transportation, accepting a proposed donation from Greenways for Nashville in the amount of $110,000 and appropriating the sum of $335,139 for work relating to a segment of the Richland Creek Greenway project adjacent to McCabe Park.

Whereas, pursuant to the terms of the contract (the "Contract") attached to this ordinance as Exhibit A, the Tennessee Department of Transporation and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation, propose to share in the cost of development of a portion of the Richland Creek Greenway (the "Project"); and

Whereas, the total cost of the Project is expected to be $1,675,683, of which the Metropolitan Government's share will be $335,139; and

Whereas, in accorandance with the letter of commitment attached to this ordinance as Exhibit B, funds in the amount of $109,877, plus accrued interest of not less than $123, will be contributed as part of the Metropolitan Government's share of Project costs by Greenways for Nashville; and

Whereas, funds in the amount of $50,000 have already been contributed as a part of the Metropolitan Government's share of Project costs by St. Thomas Hospital; and

Whereas, the funds comprising the Metropolitan Government's $335,139 contribution of the Project thus are to be derived as follows:

Whereas, approval of the Contract and acceptance of the proposed donation from Greenways for Nashville will benefit the citizens of Davidson County by enhancing the quality and availability of recreational opportunities in Davidson County.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Contract is hereby approved and the proposed contribution to the Project from Greenways for Nashville is hereby accepted.

Section 2: Any amendments, renewals or extension of the terms of the Contract must be approved by resolution of the Metropolitan Council.

Section 3: This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
