Metropolitan Council Meeting

Tuesday, September 15, 1998


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilmember Charles Fentress. 

The Metropolitan Council gave the pledge of allegiance to the American Flag.

An ordinance amending Section 10.18.010 of the Metropolitan Code to prohibit smoking in the stadium bowl. An ordinance approving a contract by and between The Metropolitan Government of Nashville and Davidson County and the Pennington Bend Tourist Development Commission for the promotion of tourism and tourist related activities in the Pennington Bend area. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.

BILL NO. O98-1384

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to enter into an agreement with the State of Tennessee, Department of Transportation, for enhancement of the Andrew Jackson Aquifer. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.

BILL NO. O98-1385

An ordinance readopting the code of The Metropolitan Government of Nashville and Davidson County, Tennessee, prepared by Book Publishing Company, including supplemental and replacement pages thereof, containing certain ordinances of a general and permanent nature enacted on or before July 1998. Upon motion duly seconded, the bill passed first reading and was referred to the Rules-Confirmations-Public Elections-Aviation Committee by a voice vote of the Council.

BILL NO. O98-1386

An ordinance amending Section 4.32.060 of the Metropolitan Code of Laws by eliminating the requirement that the sale or disposition of surplus personal property with a fair market value over $5,000 needs the approval by resolution of the Metropolitan Council. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.

BILL NO. O98-1387

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by abandoning, vacating and conveying to adjoining property owners certain property shown on Tax Map 105-6, all of which is more particularly described herein. Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Traffic and Parking Commission, Public Works, Traffic and Parking and Planning, Zoning, Historical and Port Authority Committees by a voice vote of the Council.

The rules were suspended for consideration of one (1) late bill, and no objection was made.

BILL NO. O98-1388

An ordinance authorizing A. J. Smith Company to construct, install, and maintain a fiber optic cable across Charlotte Pike between two N.E.S. poles at an elevation of 22 feet above ground, located between 31st Avenue North and Interstate 440, (Proposal No. 98M-091U), all of which is more particularly described herein. The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning, Historical and Port Authority Committees by a voice vote of the Council.

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by closing Cumberland Alley between Eighth Avenue North and Ninth Avenue North (Proposal No. 98M-063U), all of which is more particularly described herein. The bill was approved by the Planning Commission, Traffic and Parking Commission, Public Works, Traffic and Parking and Planning, Zoning, Historical and Port Authority Committees. Mr. Sloss moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. O98-1311

An ordinance to amend Title 17 of The Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a District to RS20 District properties located at 8360 Collins Road, 8722 McCrory Lane and 8269 Poplar Creek Road, approximately 1,200 feet north of Indian Hills Drive (210.86 acres), (Proposal No. 98Z-106G), all of which is more particularly described herein. The The bill was approved by the Planning Commission and the Planning, Zoning, Historical and Port Authority Committee recommended indefinite deferral. Mr. Lineweaver moved to defer action indefinitely on the bill, at the request of the property owner Herndon Family Partners, which motion was seconded and adopted by a voice vote of the Council.
