ORDINANCE NO. O98-1353
AN ORDINANCE TO AMEND CHAPTER 2.164 OF THE METROPOLITAN CODE OF LAWS BY ADDING A NEW SECTION 2.164.050, TO AUTHORIZE THE BOARD OF HOSPITALS TO ENTER INTO CONTRACTS WITH OTHER HEALTH CARE PROVIDER ORGANIZATIONS OR INSURANCE PROVIDERS TO FACILITATE PAYMENT FOR HOSPITAL SERVICES.
WHEREAS, Metropolitan Nashville General Hospital (MNGH) wishes to encourage Nashville residents to utilize the new facility, and contracts with various healthcare payers will facilitate this; and,
WHEREAS, MNGH wishes to collect payment for services rendered from the patient’s health insurance where applicable and cannot do so unless MNGH is considered a "Health Care Provider" by the payer; and,
WHEREAS, the payer will only consider MNGH a "Health Care Provider" in their system if MNGH has a contract with the payer.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:
SECTION 1. Chapter 2.164 of the Metropolitan Code of Laws, is amended by adding the following section titled "2.164.050 Contacting Authority for the Board of Hospitals".
The Board of Hospitals may enter into contracts for the receipt of payment of health care service with companies, corporations, or organizations which are in the business of providing health care insurance coverage to companies, individuals or employees or with companies, corporations or organizations which are in the business of paying for health care services on behalf of an employer or other entity; and such contract must be approved and signed by the metropolitan department of law, signed by the director of finance, and filed with the office of the metropolitan clerk.
SECTION 2. That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:
I move to amend Ordinance No. 098-1353 as follows:
Amend SECTION 1 by adding the following at the end of the last sentence:
No such contract shall create liability sounding in tort on the part of the Metropolitan Government for an amount exceeding the limits specified in the Tennessee Governmental Tort Liability Act 29-20-101 et seq. Any liability on the part of the Metropolitan Government sounding in contract shall not exceed the fees paid by the Contractor to the Metropolitan Government under the contract.
