SUBSTITUTE ORDINANCE NO. SO98-1371

A substitute ordinance authorizing the dedication of certain property described herein (part of Parcel 76, Tax Map 92-14) located on the southwest corner of Park Plaza and 25^th Avenue North, to the State of Tennessee in conjunction with the construction of Project No. 19039-2222-04.

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Tennessee, owns certain real property; and

WHEREAS, said property is currently used as the site of Centennial Park; and

WHEREAS, the State of Tennessee, in conjunction with Project No. 19039-2222-04, has need of a portion of said property for the purposes of roadway and easement areas (see Exhibit A); and

WHEREAS, the State of Tennessee has offered to pay $95,950.00 for said easement areas; and

WHEREAS, the Director of Public Property has determined said offer to be fair; and

WHEREAS, the Board of Parks and Recreation has approved this request.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. That the Director of Public Property Administration is hereby authorized and directed to convey as permanent and temporary easements a part of Parcel 76, Tax Map 92-14 (see Exhibit A), to the State of Tennessee for use in Project No. 19039-2222-04, and is hereby authorized to execute the necessary documents pertaining thereto.

SECTION 2. The proceeds shall be credited to the General Fund of the Metropolitan Government.

SECTION 3. That this ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
