ORDINANCE NO. O98-1386

An ordinance amending section 4.32.060 of the Metropolitan Code of Laws by eliminating the requirement that the sale or disposition of surplus personal property with a fair market value over $5,000, needs the approval by resolution of the Metropolitan Council.

 Whereas, the Procurement Code, adopted by the Metropolitan County Council, provides sufficient and detailed guidelines which regulate and control the disposition of surplus property and the Director of the Public Property Administration must comply with these provisions; and

Whereas, the current requirement that the sale of surplus personal property requires the approval by resolution of the Metropolitan County Council delays the Director of the Public Property Administration’s efforts in selling surplus personal property.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. Section 4.32.060 of the Metropolitan Code of Laws shall be and is further amended by deleting the second sentence in its entirety so as to read:

Surplus personal property authorized for sale under this chapter shall be sold in accordance with regulations.

Section 2. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
