ORDINANCE NO. O98-1383
An ordinance approving a contract by and between The Metropolitan Government of Nashville and Davidson County and the Pennington Bend Tourist Development Commission for the promotion of tourism and tourist related activities in the Pennington Bend area.
Whereas, Title 7, Chapter 4, Part 1 of the Tennessee Code authorizes the collection of a tourist accommodation tax and requires distribution of the said tax as follows: one percent (1%) for direct promotion of tourism; one percent (1%) for tourist related activities; and one percent (1%) to be deposited in the General Fund; and
Whereas, Section 5.12.060 B of the Metropolitan Code of Laws further requires the occupancy privilege tax attributable to the new rooms of certain large hotels to be used only for the direct promotion of tourism and tourist-related activities in any premier tourist destination area ("PTDA") as defined in Section 5.12.010; and
Whereas, such a PTDA exists in the Pennington Bend area of Nashville and Davidson County ("Pennington Bend Area"); and
Whereas, the Pennington Bend Tourist Development Commission is a duly organized, Tennessee, non-profit corporation authorized and willing to promote the tourism and tourist-related activity in the Pennington Bend area; and
Whereas, The Metropolitan Government of Nashville and Davidson County desires to enter into a contract with the Pennington Bend Tourist Development Commission to promote the tourism and tourist-related activities in the Pennington Bend area.
Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:
Section 1. That the contract between the Metropolitan Government of Nashville and Davidson County and the Pennington Bend Tourist Development Commission a copy of which is attached hereto and incorporated herein, is hereby approved and the Metropolitan Mayor is hereby authorized to execute the same on behalf of the Metropolitan Government.
Section 2. Any further amendment to the above referenced contract must be approved by resolution of the Metropolitan Council that receives at least 21 affirmative votes.
Section 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1
TO
ORDINANCE NO. O98-1383
Mr. President:
I hereby move to amend Bill No. O98-1383 by adding a new Section 2 that reads as follows:
Section 2: All funding for this contract is subject to quarterly appropriation by the Metropolitan Council, by resolution that receives twenty-one (21) affirmative votes and payment shall be in accordance with the terms of the contract and Section 5.12.060 of the Metropolitan Code of Laws.
All other provisions of Bill No. O98-1383 shall be unaffected except as provided hereunder.
