ORDINANCE NO. O98-1355
AN ORDINANCE APPROVING THE ABANDONMENT OF A CERTAIN EASEMENT ENCUMBERING A PORTION OF PARCEL 273 ON TAX MAP 163 AND THE ACCEPTANCE OF A RELOCATED, PERMANENT EASEMENT ON SAID PROPERTY.
WHEREAS, at its meeting on April 2, 1998, the Metropolitan Planning Commission approved a portion of the Commercial (General) Planned Unit Development District abutting the east margin of Cane Ridge Road approximately 600 feet south of Bell Road (.071 acres) to permit the development of a 5,490 square foot automobile service facility (Proposal No. 125-78-U); and,
WHEREAS, a condition of the Commissions approval was the relocation of an existing drainage easement through the site; and,
WHEREAS, a new permanent drainage easement has been dedicated by the property owners to replace the existing easement as of record in Plat Book 5200, Page 258, R.O.D.C., Tennessee.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:
SECTION 1. That an easement located on Lot 2, Section 7, Cloverleaf Estates, of record in Plat Book 5200, Page 258, R.O.D.C., Tennessee, and shown in Exhibit A attached hereto is hereby abandoned.
SECTION 2.That a certain drainage easement located on Lot 2, Section 7, Cloverleaf Estates, Map 163, Parcel 273 and shown on Exhibit A attached hereto is hereby accepted.
SECTION 3. That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
