ORDINANCE NO. O98-1387

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by abandoning, vacating and conveying to adjoining property owners certain property shown on Tax Map 105-6, all of which is more particularly described herein.

WHEREAS, The Metropolitan Government of Nashville and Davidson County acquired interest in the southern one-half of Alley No. 653 on tax map 105-6 (see Exhibit A) through the passage of Ordinance No. O98-1234; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County has been petitioned by M.D.H.A. and the adjoining property owners to convey property to said adjoining owners; and

WHEREAS, it has been determined that The Metropolitan Government of Nashville and Davidson County has no use for the aforementioned property.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The property shown as the southern one-half of Alley No. 653 on tax map 105-6 (see Exhibit A) is hereby abandoned, vacated and conveyed to adjoining property owners to be combined with parcel 24 on said tax map.

SECTION 2. Any easements contained within said property, whether of record or not, are hereby retained.

SECTION 3. Be it further enacted that the Director of the Department of Public Works be, and is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause said change to be made on the tax map referenced in Section 1.

SECTION 4. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.

AMENDMENT NO. 1

TO

ORDINANCE NO. O98-1387

Mr. President:

I moved to amend Ordinance No. O98-1387 by amending Section 1 by inserting the words: ",at fair market value," after the word "conveyed" and before the words "to adjoining property owners".

AMENDMENT NO. 2

TO

ORDINANCE NO. O98-1387

Mr. President:

I move to amend Ordinance No. O98-1387 by amending Section 1 thereof by adding the following provision:

"Provided, however, such property shall not be conveyed unless and until the public right-of-way which was an alley and/or street between Summit Avenue and Hillside Avenue (see Exhibit B attached hereto) is reopened as a public right-of-way."
