A resolution amending a contract between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee, Department of Transportation, to provide for Phase 2 of the Intelligent Transportation Traffic Guidance System, Project No. ITS-9747(401).

WHEREAS, on September 29, 1997, the Metropolitan Government and the State of Tennessee, Department of Transportation, entered into Contract No. 138-97, providing for implementation of Intelligent Transportation Traffic Guidance System in Nashville, Tennessee; and,

WHEREAS, Ordinance No. O97-914 approved said contract and provided that amendments thereto must be approved by resolution of the Metropolitan Council; and,

WHEREAS, The Metropolitan Government of Nashville and Davidson County and the State of Tennessee, Department of Transportation desire to amend contract No. 138-97 to implement Phase II of the Intelligent Transportation Traffic Guidance System project.

NOW THEREFORE, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

SECTION 1: That amendment submitted by the State of Tennessee, Department of Transportation to The Metropolitan Government of Nashville and Davidson County to implement Phase II of the Intelligent Transportation Traffic Guidance System project, is hereby accepted by the Metropolitan Government. The said amendment is attached hereto and made a part thereof, and made a part of this Resolution, be and the same is hereby ratified by the adoption of this Resolution.

SECTION 2: That the Metropolitan County Mayor is authorized to execute the attached amendment for Project No. ITS-9747(401), Phase II, Intelligent Transportation Traffic Guidance System project.

SECTION 3: That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
