Metropolitan Council Meeting
Tuesday, May 16, 2006


The Metropolitan Council met in regular session on this date at 7:00 p.m. in Metro City Hall.

The invocation was offered by Councilmember Billy Walls.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Dozier, Neighbors, Tucker, Briley, Dread, Gilmore, Isabel, Craddock, Murray, Jameson, Cole, Hart, Forkum, Ryman, Brown, Gotto, Burch, White, Loring, McClendon, Greer, Hausser, Wallace, Walls, Whitmore, Crafton, Summers, Shulman, Adkins, Foster, Alexander, Wilhoite, Toler, Coleman, Williams, Tygard and President Gentry (37); Absent: (0).

The Minutes of the regular meeting of May 4, 2006, were approved.

- ELECTIONS AND CONFIRMATIONS -

Board of Public Education

The President called for an election to fill a vacancy on the Metropolitan Board of Public Education from School District 5 as required by law. Nominations filing by the filing deadline were: Kay Brooks, Gracie Porter, Richard Tennent, and Charles Townsend. The nominations of Messrs. Tennent and Townsend were subsequently withdrawn. Mr. Adkins reported that the Rules-Confirmations-Public Elections Committee had interviewed the two remaining candidates and found both qualified to serve. The President called for the vote, which was recorded as follows: Brooks - Dozier, Dread, Craddock, Hart, Forkum, Ryman, Brown, Gotto, Burch, White, Loring, Wallace, Whitmore, Crafton, Foster, Alexander, Toler, Tygard (18); Porter - Neighbors, Tucker, Briley, Gilmore, Isabel, Murray, Jameson, Cole, Greer, Hausser, Walls, Summers, Shulman, Adkins, Wilhoite, Coleman, Williams (17). The President announced that Ms. Brooks had been elected to fill vacancy on the Metropolitan Board of Public Education for School District 5.

Alarm Appeals Board
Appointment of Mr. Charles Scott for a term expiring November 4, 2007. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Community Access Television Special Committee
Appointment of Ms. Marcie Smeck for a term expiring March 1, 2009. Without objection, the nomination was deferred to June 6, 2006.

Community Corrections Advisory Board
Appointment of Ms. Eileen Parrish for a term expiring August 31, 2006. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Board of Equalization
Appointment of Mr. Will Cheek for a term expiring April 1, 2008, as a General Services District representative. Without objection, the nomination was deferred to June 6, 2006.

Reappointment of Mr. Charles W. Cook, Jr. for a term expiring April 1, 2008, as an Urban Services District representative. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Mr. Mark Deutschmann for a term expiring April 1, 2008, as an Urban Services District representative.
Without objection, the nomination was deferred to June 6, 2006.

Human Relations Commission
Reappointment of Mr. German Castro for a term expiring April 18, 2009. Planning Commission
Appointment of Mr. Phil Ponder for a term expiring March 31, 2010. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Public Library Board
Appointment of Dr. Reavis Mitchell for a term expiring April 6, 2013. Without objection, the nomination was withdrawn.

Appointment of Mr. Byron Trauger for a term expiring April 6, 2008. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Social Services Commission
Reappointment of Ms. Gwendolyn Harris for a term expiring April 3, 2011. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Transit Authority
Reappointment of Ms. Marian Ott for a term expiring May 1, 2011. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Zoning Appeals Board
Appointment of Mr. David Ewing for a term expiring February 26, 2009. RESOLUTION NO. RS2006-1244

A resolution appropriating One Million Eight Hundred Thousand Dollars ($1,800,000) from the Unappropriated Fund Balance of the General Fund of the General Services District to Nashville Alliance for Public Education, Inc. to provide funding for technology and science equipment for use in public schools. The resolution was approved by the Education Committee; the Budget and Finance Committee recommended indefinite deferment. Mr. Tygard moved to defer the resolution indefinitely, which motion was seconded and adopted by a roll call vote of the Council.

Without objection Resolution Nos. RS2006-1259 and BL2006-1309 were considered together.

RESOLUTION NO. RS2006-1259

A resolution appropriating $30,000 for the Metropolitan Board of Health pursuant to a grant from the U.S. Environmental Protection Agency for the characterization of ambient concentrations of hazardous air pollutants. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2006-1309

A resolution approving an amendment to a grant from the U.S. Environmental Protection Agency to The Metropolitan Government of Nashville and Davidson County for characterization of concentrations of air pollutants. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

A resolution authorizing the execution, terms, issuance, sale and payment of general obligation bonds in the aggregate principal amount of not to exceed $203,780,000 of The Metropolitan Government of Nashville and Davidson County (Tennessee) and amending Substitute Resolution No. RS2006-1269, adopted April 18, 2006. The resolution was approved by the Budget and Finance Committee. An ordinance amending the ability of taxicab drivers to discharge passengers in the farthest right lane of traffic when the curb is blocked by parked vehicles. An ordinance granting the authority to the Metropolitan Transportation Licensing Commission to authorize taxicabs to charge a temporary fuel surcharge. BILL NO. BL2006-1064

An ordinance amending Section 12.68.210 of the Metropolitan Code of Laws to prohibit the use of mobile telephones while driving, unless a hands free device is used. Upon motion duly seconded, the bill passed first reading and was referred to the Public Safety-Beer and Regulated Beverages Committee by a voice vote of the Council.

BILL NO. BL2006-1065

An ordinance amending Section 13.32.120 of the Metropolitan Code of Laws to prohibit chain link fences along arterial and collector streets. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works Committee by a voice vote of the Council.


BILL NO. BL2006-1066

An ordinance amending Section 16.04.090 of the Metropolitan Code of Laws to require property owners to obtain permit bonds for certain residential building construction and repairs. Upon motion duly seconded, the bill passed first reading and was referred to the Codes, Fair and Farmers Market Committee by a voice vote of the Council.

BILL NO. BL2006-1067

An ordinance amending Section 16.24.190 of the Metropolitan Code of Laws regarding the prosecution for repeat violations of the Property Standards Code. An ordinance amending Section 16.24.330 of the Metropolitan Code of Laws to limit the duration portable storage units may be on residential property. BILL NO. BL2006-1069

An ordinance amending Section 16.28.040 of the Metropolitan Code of Laws to prohibit the issuance of a building permit if the applicant or property owner has been found guilty within the past twelve months of violating a stop work order issued by the Department of Codes Administration or violating T.C.A. § 7-51-1201. Upon motion duly seconded, the bill passed first reading and was referred to the Codes, Fair and Farmers Market Committee by a voice vote of the Council.

BILL NO. BL2006-1070

An ordinance authorizing the Metropolitan Government to participate with Burkitt Place Development LLC, to provide public sewer service in Davidson and Williamson County to Burkitt Place Phase 1-A, Section 2, Project No. 05-SL-114A. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.

BILL NO. BL2006-1071

An ordinance authorizing the Metropolitan Government to participate with Pulte Homes, Tennessee LP, to provide public sewer service in Williamson County to Winterset Woods Section 3, Project No. 05-SL-184. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.

BILL NO. BL2006-1072

An ordinance abandoning a 15", 12" and an 8" sanitary sewer line and easement that will be replaced by a 15", 12" and an 8" sanitary sewer line and easement, that is shown on Map 161, Parcels 101-103, 105, 107, 112, and 189 and Map 162, Parcels 78-82, Project 05-SL-118, Wal-Mart, Nolensville Road, and authorizing the execution of the documents to carry out the abandonment (Proposal No. 2005M-211U-12). The bill was approved by the Planning Commission.
