ORDINANCE NO. BL2006-1039

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS7.5 and OL to SP district properties located at 4601 and 4603 Gallatin Pike and Broadmoor Drive (unnumbered), northwest corner of Gallatin Pike and Broadmoor Drive (.84 acres), to permit a 960 square feet retail uses, 1,109 square feet of retail storage, and 531 square feet for a coffee shop/refreshment counter, (0.88 acres), all of which is described here in (Proposal No. 2006SP-052U-05).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, is hereby amended by changing the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of Title 17 by reference, as follows:

By changing from RS7.5 and OL to SP district properties located at 4601 and 4603 Gallatin Pike and Broadmoor Drive (unnumbered), northwest corner of Gallatin Pike and Broadmoor Drive (.84 acres), to permit a 960 square feet retail uses, 1,109 square feet of retail storage, and 531 square feet for a coffee shop/refreshment counter, (0.88 acres), as being Property Parcel Nos. 049, 050, 051, 052 as designated on Map 061-07 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is described by lines, words and figures on the plan dated February 28, 2006 that was duly considered by the Metropolitan Planning Commission, and which is on file with the Metropolitan Planning Department and made a part of this ordinance as though copied herein.

Section 2. Be it further enacted, that the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet No. 061 of said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

Section 3. Prior to any additional development applications for this property, the applicant shall provide the Planning Department with a final corrected copy of the SP plan for filing and recording with the Davidson County Register of Deeds.

Section 4. Be it further enacted, that the following conditions be added to the SP plan, or be satisfied, completed, or bonded prior to final SP approval:

1. Only the uses listed as allowable within the MUN zoning district shall be permitted except that no Special Event uses are permitted in this SP.

2. All off-site traffic conditions, as recommended by Public Works, must be bonded or completed prior to the recordation of the final plat.

4. For any development standards, regulations and requirements not specifically shown on the SP plan and/or included as a condition of Commission approval, the property shall be subject to the standards, regulations and requirements of the MUN zoning district. This shall be noted on the plan.

5. Prior to any final site plan approval all parking spaces proposed within 20 feet of public right-of-way shall be eliminated.

Section 5. Be it further enacted, that this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:

I move to amend Ordinance No. BL2006-1039 by amending Section 4 by deleting condition number 5 in its entirety and substituting in lieu thereof the following new condition 5:

"5. Prior to any final site plan approval, for all parking areas with ten or more spaces, all spaces proposed within twenty feet of public right-of-way shall be eliminated."
