ORDINANCE NO. BL2006-1073

An ordinance abandoning an 8" sanitary sewer line and easement and accepting a new 8" sanitary sewer line, fire hydrant, and easement, as shown on Map 104-9, Parcel 163.00, Project Nos. 04-SL-201 and 05-WL-19, Southgate Condominiums, and authorizing the execution of necessary documents (Proposal No. 2005M-095U-10).

WHEREAS, an existing 8" sanitary sewer line and accompanying easement, more particularly described in Project Nos. 04-SL-201 and 05-WL-19, Southgate Condominiums, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, an 8" sanitary sewer line and easement of equal size, inclusive of a fire hydrant, (collectively, "New Easement") will be replacing the existing 8" sanitary sewer line and easement; and

WHEREAS, the New Easement is described in the plans for Project Numbers 04-SL-201 and 05-WL-19, on file with the Department of Water and Sewerage Services, and is located on the property described in Exhibit 1 hereto; and

WHEREAS, grant of the New Easement has been executed by the respective property owner and offered to the Metropolitan Government of Nashville and Davidson County; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2005M-095U-10 on May 20, 2005.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Metropolitan Government hereby abandons the 8" sanitary sewer line and the easement shown on Map 104-9, Parcel 163.00, Project Nos. 04-SL-201 and 05-WL-19, Southgate Condominiums, as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2. The Metropolitan Government of Nashville and Davidson County, by and through the Director of Public Property Administration, is hereby authorized to accept from the respective property owner the New Easement and improvements, as described in the plans for Project Numbers 04-SL-201 and 05-WL-19, on file with the Department of Water and Sewerage Services, and located on the property described in Exhibit 1 hereto, which plans and exhibit are incorporated herein.

SECTION 3. The easement shall be filed in the Office of the Register of Deeds to evidence its acceptance.

SECTION 4. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
