RESOLUTION NO. RS2006-1244

A Resolution appropriating One Million Eight Hundred Thousand Dollars ($1,800,000) from the Unappropriated Fund Balance of the General Fund of the General Services District to Nashville Alliance for Public Education, Inc. to provide funding for technology and science equipment for use in public schools.

WHEREAS, on February 21, 2006, the Metropolitan Council approved Resolution No. RS2006-1140, which consented to the assignment of the amended and restated lease for the Renaissance Nashville Hotel from RHOC Nashville Hotel, LLC to HH Nashville, LLC; and

WHEREAS, the Renaissance Hotel lease provide that the Metropolitan Government is entitled to a twenty percent share of the anticipated profit from the assignment, which share amounted to $2,234,000, less twenty percent of the closing costs, which amount has been deposited into the Unappropriated Fund Balance of the General Fund of the General Services District; and

WHEREAS, T.C.A. § 7-3-314 enables the Metropolitan Government to appropriate funds for the financial aid of a nonprofit organization which is exempt from taxation pursuant to § 501(c)(3) of the Internal Revenue Code of 1954, as amended (sic), provided that such funds appropriated shall be used to promote the general welfare of the residents of Metropolitan Government; and

WHEREAS, Nashville Alliance for Public Education, Inc. is a tax exempt organization under the provisions of § 501(c)(3) of the Internal Revenue Code of 1986, as amended, whose mission is to raise funding to help improve Nashville public schools "for our city and our collective future"; and

WHEREAS, in accordance with § 5.04.060 of the Metropolitan Code of Laws, the Nashville Alliance for Public Education has filed with the Metropolitan Clerk (1) a copy of its corporate charter or other articles, constitution, bylaws, or instruments of organization; (2) a copy of a letter from the Internal Revenue Service evidencing the fact that the organization is a nonprofit, tax-exempt organization under the Internal Revenue Code of 1986, as amended; (3) a statement of the nature and extent of the organization's program that serves the residents of the metropolitan government; (4) the proposed use of the funds to be provided by the metropolitan government; (5) the proposed budget of the organization, indicating all sources of funds and a line-item identification of the proposed expenditure of metropolitan government funds; and (6) a copy of the organization's audit for the most recent fiscal year; and

WHEREAS, the Council desires to use a portion of the proceeds received from the Renaissance Hotel lease transfer to provide programming funding for the Nashville Alliance for Public Education for the purpose of purchasing technology and science equipment for the public schools.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the sum of One Million Eight Hundred Thousand Dollars ($1,800,000) is hereby appropriated from the unappropriated fund balance of the General Fund of the General Services District to the Nashville Alliance for Public Education to provide funding for technology and science equipment for use in public schools.

Section 2. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
