An Ordinance amending Section 17.40.300 of Title 17 of the Metropolitan Code, Zoning Regulations, to require the Board of Zoning Appeals to provide the applicant for a special exception with a copy of the Planning Commission Report regarding the application prior to the public hearing, all of which is more specifically described herein (Proposal No. 2006Z-049T).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and the same is hereby amended by amending Section 17.40.300 by adding the following provision at the end thereof:

"Upon request by the applicant, the board shall furnish a copy of the planning commission report or analysis regarding the proposed special exception to the applicant not less than forty-eight hours prior to the public hearing required by section 17.40.310."

Section 2. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
