ORDINANCE NO. BL2006-1079

An ordinance declaring surplus and approving the disposition of a certain parcel of property, known as the Municipal Garage, by the Director of Public Property (Proposal No. 2006M-067U-09).

Whereas, the Metropolitan Government owns a certain parcel of property located at 413 Fifth Avenue North, Nashville, Tennessee 37219, being Map 093-02, Parcel 014; and

Whereas, the Metropolitan Government of Nashville and Davidson County has determined that this certain parcel of property, described in Exhibit A which is attached hereto and incorporated herein, is no longer needed for governmental purposes; and

Whereas, the Director of Public Property Administration is authorized to sell said property subject to the approval of the Metropolitan Council and the Mayor.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Metropolitan County Council declares the following parcel of land owned by Metropolitan Government to be surplus:

Section 2. The Director of Public Property is hereby authorized and directed to dispose of said property listed above.

Section 3. The proceeds from the sale of said parcel of property shall be deposited in the general fund of the district from whose operating budget the last department, commission, board or agency using the real property is financed.

Section 4. This Ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:

I move to amend Ordinance No. BL2006-1079 by adding the following two new recitals prior to the last recital:

"Whereas, it is anticipated that this certain parcel of property will be deeded to the Metropolitan Transit Authority; and

Whereas, the amount of net revenues generated by the Metropolitan Transit Authority from the operation of the garage located on said property shall be deducted from the annual appropriation made to the Metropolitan Transit Authority as part of the operating budget ordinance for the Metropolitan Government; and"
