SUBSTITUTE RESOLUTION NO. RS2006-1325

A resolution requesting the Tennessee Department of Transportation to install noise abatement walls along Interstate 40 West in the vicinity of the Bellevue/Newsome Station exit.

WHEREAS, George Horn Road is a residential street extending along Interstate 40 West approximately one-half mile west of exit 196 in the Bellevue area; and

WHEREAS, due to the extremely close proximity of George Horn Road to the interstate, residents in the Pine Forest subdivision are forced to endure the constant noise of the interstate traffic; and

WHEREAS, Nashville Electric Service recently cut down a small growth of trees serving as a barrier between George Horn Road and the interstate, which has exacerbated the noise problem in the area; and

WHEREAS, noise abatement walls have proven to substantially reduce highway noise levels in residential areas; and

WHEREAS, as part of its responsibility for the construction and maintenance of state roads and highways, the Tennessee Department of Transportation often installs noise abatement walls to protect the citizens in the vicinity of the highway; and

WHEREAS, it is fitting and proper that the Tennessee Department of Transportation construct noise abatement walls along this section of Interstate 40 to limit the negative impact the highway noise is having on the residents of the area.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Tennessee Department of Transportation to install noise abatement walls along Interstate 40 West in the vicinity of the Bellevue/Newsome Station exit.

Section 2. That the Metropolitan Clerk is directed to send a copy of this Resolution to Tennessee Department of Transportation Commissioner Gerald Nicely.

Section 3. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
