SUBSTITUTE RESOLUTION NO. RS2006-1323
A resolution expressing the Metropolitan Council's intent to withhold funding for Metropolitan Government Departments that fail to ensure that all department management have received training regarding Title VI compliance prior to the end of the current fiscal year until a corrective action plan is filed.WHEREAS, Title VI of the Civil Rights Act of 1964 prohibits discrimination on the basis of race, color and national origin in programs an d activities receiving federal financial assistance; and
WHEREAS, if a recipient of federal funding is found to have discriminated on the basis of race, the federal government may terminate funding or turn the matter over to the U.S. Department of Justice for the appropriate legal action; and
WHEREAS, the Metropolitan Government receives millions of dollars in direct and pass-through funding from the federal government each year; and
WHEREAS, it is the policy of the Metropolitan Government that all persons have equal opportunity employment opportunities regardless of race or color; and
WHEREAS, in order to comply with this policy, as well as with federal law, the departments and agencies of the Metropolitan Government should ensure that all management-level employees receive adequate Title VI training; and
WHEREAS, the Metropolitan Council is concerned that Metropolitan Government employees are currently not being adequately trained regarding Title VI compliance; and
WHEREAS, it is
fitting and proper that the Metropolitan Council withhold funding for Metropolitan
Government departments that have failed to adequately provide Title VI training.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the Metropolitan County Council hereby goes on record as expressing its intent to withhold funding for Metropolitan Government Departments that fail to ensure that all department management have received training regarding Title VI compliance prior to the end of the current fiscal year until a corrective action plan is filed.
Section 2. The Metropolitan Clerk is directed to send a copy of this resolution to Mayor Bill Purcell and to each department head of the Metropolitan Government.
Section 3. This Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
