ORDINANCE NO. BL2006-1056

An ordinance approving and authorizing the Mayor to execute a contract with CSX Transportation Inc. and Beazer Homes Corporation for the construction and acceptance of a roadway bridge over a CSX Transportation Inc. right-of- way at Railroad Milepost 00N-14.69 in Davidson County, Tennessee (Proposal No. 2006M-061G-06).

Whereas, CSX Transportation Inc. is willing to cooperate with Beazer Homes Corporation and the Metropolitan Government regarding the building of a roadway bridge over a CSX right of way and property and the dedication and acceptance of said bridge by the Metropolitan Government upon final inspection, pursuant to the terms of the contract attached hereto ("Contract"); and

Whereas, it is in the best interests of the Metropolitan Government to approve this contract.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Contract between The Metropolitan Government of Nashville and Davidson County, Beazer Homes Corporation, and CSX Transportation Inc. for the construction and acceptance of a roadway bridge over a CSX Transportation Inc. right of way at Railroad Milepost 00N-14.69 in Davidson County, Tennessee, attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That any amendments, renewals or extension of the terms of the Contract must be approved by Resolution of the Metropolitan Council.

Section 3. That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
