ORDINANCE NO. BL2006-1063
An ordinance granting the authority to the Metropolitan Transportation Licensing Commission to authorize taxicabs to charge a temporary fuel surcharge.
Whereas, Chapter 6.72 of the Metropolitan Code allows the Metropolitan Transportation Licensing Commission to authorize certain surcharges to taxicab fares; and
Whereas, the Transportation Licensing Commission recognizes that the fluctuations in the price of gasoline causes the need for temporary surcharges from time to time for operators of taxicabs to compensate during times of higher gasoline prices; and
Whereas, it is therefore deemed necessary for the Metropolitan Government to make the following amendments to the taxicab regulations.
Now therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:
Section 1. Chapter 6.72 of the Metropolitan Code of Laws is amended by creating a new subsection (E) in section 6.72.250 which shall read: "The metropolitan transportation licensing commission may authorize a temporary fuel surcharge in accordance with commission rules."
Section 2. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:
I move to amend Ordinance No. BL2006-1063 by adding the following provision at the end of Section 1:
"Any temporary fuel surcharge imposed by the transportation licensing commission pursuant to this subsection shall not exceed six months in duration and shall not exceed five percent (5%) of the taxicab rates charged."
