ORDINANCE NO. BL2006-1018

An ordinance authorizing the Metropolitan Mayor to enter into Water, Sewer and Cable Line Agreement No. 600,044 with Nashville and Eastern Railroad Corporation, allowing the Department of Water and Sewerage Services to construct and maintain water, sewer, cable lines overhead, 1500 foot easterly, M.P. 3.0 (actual M.P. 3.29), and authorizing all future overhead cable license agreements with Nashville and Eastern Railroad Corporation by Resolution.

WHEREAS, Nashville and Eastern Railroad Corporation owns and maintains railroad tracks in Davidson County and some surrounding counties; and

WHEREAS, the Metropolitan Department of Water and Sewerage Services needs to construct a water, sewer or cable line in the existing railroad right-of-way located 1500 feet easterly at M.P. 3.0 (actual M.P. 3.29); and

WHEREAS, Nashville and Eastern Railroad Corporation proposes to permit the Metropolitan Department of Water and Sewerage Services to construct water, sewer and cable lines in the railroad right-of-way in connection with the project pursuant to the terms of the agreement attached to this Ordinance as Exhibit A; and

WHEREAS, this work is identified in METRO'S CAPITAL IMPROVEMENTS BUDGET No. 96SG0005.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Mayor, or his designee, is hereby authorized to execute Agreement No. 600,044, copy attached as Exhibit A, and all future overhead cable license agreements with Nashville and Eastern Railroad Corporation may be approved by Resolution of Council.

SECTION 2: That this Ordinance shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
