Metropolitan Council Meeting
Tuesday, November 16, 1999


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Rev. Battle Beasley.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the regular meeting of November 2, 1999 were approved.

- ELECTIONS AND CONFIRMATIONS -

Davidson County Public Defender

The President announced that an election would be held to fill the vacancy in the office of Davidson County Public Defender, and the nominees were: Ross E. Alderman and Shirley A. Fitzgerald Corry. Mr. Waters, Chairman of the Rules-Confirmations-Public Elections-Aviation Committee, reported that the Committee had considered and found both candidates to be qualified for the office. The ballot was taken, and the Clerk reported the following vote: "Alderman" Ferrell, Waters, Briley, Gentry, Tucker, Black, Nollner, Majors, Hall, Beehan, Campbell, Hart, Balthrop, Brown, Ponder, Derryberry, Stanley, Loring, McClendon, Greer, Hausser, Hand, Bogen, Summers, Shulman, Arriola, Sontany, Alexander, Kerstetter, Knoch, Jenkins, Turner, Williams, and Lineweaver (34); "Corry" Gilmore, Dillard, Wallace, Haddox, Whitmore, Holloway, (6). Electrical Examiners and Appeals Board

Reappointment of Mr. Lewis Greg Langley to the Electrical Examiners and Appeals Board.  Mr. Waters, Chairman of the Rules-Confirmations-Public Elections-Aviation Committee, reported that the Committee had considered and recommended the appointment of Mr. Langley to the Electrical Examiners and Appeals Board. Mr. Waters moved to confirm the appointment, which motion was seconded and adopted by a unanimous vote of the Council.

Health and Educational Facilities Board

The President called for nominations for fill one (1) vacancy on the Health and Educational Facilities Board of The Metropolitan Government of Nashville and Davidson County. Ms. Gilmore nominated Dr. Gadson Jack Tarleton, Jr. There being no further nominations, the nominations ceased. The nominee was referred to the Rules-Confirmations-Public Elections-Aviation Committee for a recommendation, and an election will be conducted at the next regular meeting of the Council.

Industrial Development Board

The President called for nominations for fill four (4) vacancies on the Industrial Development Board of The Metropolitan Government of Nashville and Davidson County. Mr. Loring nominated Mrs. Nettie Scalf; Mr. Alexander nominated Mr. David Dice; Mr. Wallace nominated Mr. Harvey Hoskins and Mr. Michael Hampton. There being no further nominations, the nominations ceased. The nominees were referred to the Rules-Confirmations-Public Elections-Aviation Committee for a recommendation, and an election will be conducted at the next regular meeting of the Council.

Council Audit Committee

The President announced that an election would be held at the next regular meeting of the Council to elect two members of Council to its Audit Committee.

RESOLUTION NO. RS99-29

A resolution approving an update to the Solid Waste Regional Plan for Davidson County, Tennessee. The resolution was approved by the Public Works Committee. RESOLUTION NO. RS99-53

A resolution requesting the Tennessee Department of Environment and Conservation to rescind its approval permitting the recycling of radioactive metals from the Oak Ridge nuclear weapons facility. The resolution was approved by the Public Works Committee. RESOLUTION NO. RS99-54

A resolution requesting the Metropolitan Board of Public Education to name a school facility, except for a schoool building,  in honor of Vic Varallo. The resolution was approved by the Education Committee as amended. Mr. Ponder offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. RESOLUTION NO. RS99-55

A resolution requesting Nashville Electric Service to reconsider its announced increase of the reconnection fee for customers disconnected from service for lack of payment. The Budget and Finance Committee recommended deferment of the resolution. Mr. Hall moved to defer action on the resolution to the second meeting in December, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS99-56

A resolution requesting the Mayor to attempt to find a method to fund additional police officers this fiscal year. The resolution was approved by the Public Safety-Beer, Wine and Whiskey Committee. Mr. Hall moved to adopt the resolution, which motion was seconded. After discussion, Mr. Lineweaver called for the previous question, which motion was seconded and adopted without objection. RESOLUTION NO. RS99-57

A resolution requesting the Metro Solid Waste Region Board to adopt a new five-year Solid Waste Management Plan. Mr. Briley requested permission to withdraw the resolution, which permission was granted by the unanimous vote of the Council.

A resolution appropriating funds from increased revenue sources to the Metropolitan Board of Parks and Recreation. The resolution was approved by the Budget and Finance and Parks, Library, Recreation and Auditorium Committees. A resolution approving an agreement by and between the Alcohol and Drug Council of Middle Tennessee and the Metropolitan Government, by and through the Board of Health, to provide services related to the Community Prevention Initiative for Children in an amount not to exceed $152,000.00. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees. A resolution approving modifications to four agreements between and among The Metropolitan Government of Nashville and Davidson County; NEO Nashville, LLC; and MM Nashville Energy, LLC relating to the development and operation of a landfill gas collection system and a small electric power generating facility on the sites of the Bordeaux landfill and the Whites Creek wastewater treatment plant. RESOLUTION NO. RS99-70

A resolution authorizing the Director of Public Property to exercise an option to purchase a permanent easement (located on Parcel 47 on Tax Map 156) in which to install and maintain a water line to serve the new Warner Park Nature Center Complex. An ordinance authorizing the Metropolitan Mayor to submit a five year Consolidated Plan for Housing and Community Development programs to the U.S. Department of Housing and Urban Development. An ordinance accepting the donation of a 1986 GMC pickup truck and a 1985 Ford van from the Drug Court Foundation to The Metropolitan Government of Nashville and Davidson County. An ordinance approving a grant from the U.S. Department of Treasury, Bureau of Alcohol, Tobacco and Firearms to The Metropolitan Government of Nashville and Davidson County, acting through the Metropolitan Police Department for the Gang Resistance Education and Training Program (G.R.E.A.T). Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Safety-Beer, Wine and Whiskey Committees by a voice vote of the Council.

BILL NO. BL99-73

An ordinance approving a Joint Funding Agreement between the United States Department of the Interior, Geological Survey, and The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, for the period October 1, 1999 to September 30, 2000, for the operation of stream flow gauging stations, the Cumberland River (UVM) and Cumberland River water quality sampling and monitoring sites in Davidson County. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.

An ordinance approving and authorizing the Metropolitan Mayor to execute an agreement permitting the privately-funded construction of golf facilities and the provision of youth-oriented instruction and programming in Shelby Park. BILL NO. BL99-76

An ordinance authorizing the acceptance of certain property for use as park space and an easement for use as a greenway and authorizing the Metropolitan Mayor to execute an agreement relating to the construction of certain improvements to the greenway by and at the expense of WP East Acquisitions, LLC. Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Budget and Finance, Parks, Library, Recreation and Auditorium and Planning, Zoning, Historical and Port Authority Committees by a voice vote of the Council.

BILL NO. BL99-77

An ordinance authorizing the acceptance of a proposal to The Metropolitan Government of Nashville and Davidson County from the State of Tennessee, Department of Transportation relating to Project No. 19002-2175-44, I-24 Widening from East of I-440 to East of Haywood Lane, and authorizing the approval by resolution of the Metropolitan Council of utility relocation, maintenance of traffic signals and/or street lighting or other contracts and documents associated with this Project No. 19002-2175-44. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.

BILL NO. BL99-78

An ordinance authorizing the acquisition of property by negotiation or condemnation for the purpose of acquiring utility easements for use in public projects of the Metropolitan Government and specifically with relation to Project No. 97-WG-66B, Hickory Plaza 24" Water Main. The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Public Works and Planning, Zoning, Historical and Port Authority Committees.

BILL NO. BL99-79

An ordinance authorizing Qwest Communications Corporation to construct, install, and maintain a fiber optic cable at a depth of 48" to 120" within the right-of-way of Metroplex Drive between Harding Place and the terminus of Metroplex Drive, (Proposal No. 99M-133U-08), all of which is more particularly described herein. The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was re-referred to the Planning Commission and referred to the Public Works and Planning, Zoning, Historical and Port Authority Committees by a voice vote of the Council.

An ordinance abandoning a sewer easement encumbering Map 117-11, Parcel 59, 71, 72 and 85, of the proposed Green Hills Library, Project No. 98-SL-277, and authorizing the Metropolitan Mayor to execute the attached document. SUBSTITUTE BILL NO. SBL99-61

A substitute ordinance to amend Title 6, Chapter 6.54 of the Metropolitan Code of Laws concerning sexually oriented businesses. The bill was approved by the Planning Commission and Planning, Zoning, Historical and Port Authority Committee.
