ORDINANCE NO. BL99-75

An ordinance adopting the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County.

Whereas, Metropolitan Code of Laws, S 13.08.010 created and established the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, said map being composed of a series of Atlas Sheets Base Maps showing thereon the dedicated streets and alleys which were either accepted or abandoned for public maintenance by the Metropolitan Government; and,

Whereas, the Official Street and Alley Acceptance and Maintenance Map is on file in the office of the Department of Public Works and the Director of Public Works is authorized to note thereon any amendatory ordinance enacted by the Metropolitan Council; and,

Whereas, the Official Street and Alley Acceptance and Maintenance Map was last amended by Bill No. O98-1473 which was enacted by the Metropolitan Council on January 19, 1999; and,

Whereas, streets and alley ways within Davidson County have, since the enactment of Bill No. O98-1473 been duly accepted and abandoned for public maintenance by the Metropolitan Council and duly recorded on the Official Street and Alley Acceptance and Maintenance Map in the office of the Department of Public Works, but the Map itself has not been amended; and

Whereas, for the above reasons, it is deemed to be in the best interest of the Metropolitan Government to further amend the Official Street and Alley Acceptance Map.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, with the recordations of additions and

deletions of acceptances, abandonments as reflected on the Map to

date, said Map being on file with the Department of Public Works, is hereby ratified, approved and adopted.

Section 2. That the Department of Public Works will annually submit for adoption such additions, deletions or other amendments to the Official Street and Alley Acceptance and Maintenance Map as may occur from the enactment of this ordinance.

Section 3. Should any court of competent jurisdiction declare any section, clause, or provision of this ordinance to be unconstitutional, such decision shall affect only such section, clause or provision so declared unconstitutional, and shall not affect any other section, clause or provisions of this ordinance, it being the express intent of the Metropolitan County Council of the The Metropolitan Government of Nashville and Davidson County that the remainder of this ordinance continue in full force and effect.

Section 4. That this Ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
