ORDINANCE NO. BL99-74

An ordinance approving and authorizing the Metropolitan Mayor to execute an agreement permitting the privately-funded construction of golf facilities and the provision of youth-oriented instruction and programming in Shelby Park.

WHEREAS, the Metropolitan Government owns and operates certain facilities for the provision of sports and recreational opportunities, including golf, to the citizens of Davidson County; and

WHEREAS, the Tennessee Golf Foundation has agreed to build at its expense a facility (the "Facility") in Shelby Park consisting of a nine-hole golf course, a clubhouse and a driving range for the Metropolitan Government and to establish and support an on-going program devoted to providing and improving opportunities for young people in Davidson County to learn and play golf pursuant to the terms of the Agreement (the "Agreement") attached as Exhibit A and incorporated into this Ordinance by reference; and

WHEREAS, entry into the Agreement will benefit the citizens of Davidson County by enhancing the quality and availability of sports and recreational opportunities in Davidson County.

NOW THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Mayor is hereby authorized to execute the attached Agreement between The Metropolitan Government of Nashville and Davidson Countyand the Tennessee Golf Foundation.

SECTION 2: That any amendments, renewals or extension of the terms of the Agreement must be approved by Resolution of the Metropolitan Council.

SECTION 3: That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
