ORDINANCE NO. BL99-83

An ordinance abandoning a sewer easement encumbering Map 93-9, Parcel 100, of the proposed White Castle Systems, Inc., Project No. 97-SL-34 and authorizing the Metropolitan Mayor to execute the attached document.

WHEREAS, White Castle Systems, Inc., is the owner of real property encumbered by a sewer easement; and,

WHEREAS, White Castle Systems, Inc., has installed a new sewer line which adequately serves the lots and the neighboring properties; the easement of record in Book10447, Page 645, R.O.D.C., Tennessee; and,

WHEREAS, a portion of the easement is no longer being used by the Department of Water and Sewerage Services, more particularly described on the plans for Project No. 97-SL-34, White Castle Systems, Inc., on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and,

WHEREAS, the Department of Water and Sewerage Services has no need for the said portion of easements; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment of said portion of easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That this portion of the sewer easement shown on Map 93-9, Parcel 100, is declared abandoned, and the Metropolitan Mayor is hereby authorized to execute the appropriate instruments to carry out such abandonment.

SECTION 2: That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
