ORDINANCE NO. BL99-86

An ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by amending Section 17.16.110 and Section 17.16.210 by providing setback requirements for construction/demolition landfill facilities from parks and schools, all of which is more particularly described herein.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and the same is hereby amended as follows:

By amending Section 17.16.110 A. 2. Setback. by deleting the period at the end of the sentence and adding the following provision:

", and further the facility shall not be located within three miles of the property line of any school or park."

SECTION 2. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and the same is hereby amended as follows:

By amending Section 17.16.210 A. 1. Setback. by deleting the period at the end of the sentence and adding the following provision:

", and further the facility shall not be located within three miles of the property line of any school or park."

SECTION 3. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

TO

ORDINANCE NO. BL99-86

Mr. President:

I move to amend Ordinance No. BL99-86 by amending Section1 and Section 2 thereof by deleting the phrase "within three (3) miles" wherein it appears in those sections, and substituting in lieu thereof the phrase "within two (2) miles".
