ORDINANCE NO. BL99-80

An ordinance abandoning sewer and utility easements encumbering Map 117-11, Parcels 59, 71, 72 and 85, of the proposed Green Hills Library, Project No. 98-SL-277, and authorizing the Metropolitan Mayor to execute the attached document.

WHEREAS, Metro Government M is the owner of real property encumbered by sewer and utility and drainage easements; and,

WHEREAS, Metro Government M has installed a new sewer line which adequately serves the lots and the neighboring properties; and,

WHEREAS, a portion of the sewer easement is no longer being used by the Department of Water and Sewerage Services, more particularly described  on the plans for Project No. 98-SL-277, on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and,

WHEREAS, the Department of Water and Sewerage Services has no need for the said portion of easements; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment of said portion of easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That this portion of the sewer and utility and drainage easements shown on Map 117-11, Parcels 59, 71, 72 and 85, are declared abandoned, and the Metropolitan Mayor is hereby authorized to execute the appropriate instruments to carry out such abandonment.

SECTION 2: That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
