ORDINANCE NO. BL99-76

An ordinance authorizing the acceptance of certain property for use as park space and an easement for use as a greenway and authorizing the Metropolitan Mayor to execute an agreement relating to the construction of certain improvements to the greenway by and at the expense of WP East Acquisitions, LLC.

WHEREAS, WP East Acquisitions, LLC seeks to transfer to the Metropolitan Government for use as park space certain real property (the "Park Property") in accordance with the terms of the document attached as Exhibit A and incorporated into this Ordinance by reference; and

WHEREAS, WP East Acquisitions, LLC seeks to transfer to the Metropolitan Government for use as as greenway an easement (the "Greenway Easement") in real property in accordance with the terms of the document attached as Exhibit B and incorporated into this Ordinance by reference; and

WHEREAS, WP East Acquisitions, LLC has agreed to construct the greenway at its expense and in accordance with terms of the document (the "Greenway Agreement") attached as Exhibit C and incorporated into this Ordinance by reference; and

WHEREAS, acceptance of the Park Property and the Greenway Easement and approval of the Greenway Agreement will benefit quality of life for citizens of Davidson County by improving the availability of park and greenway space.

NOW THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Mayor is hereby authorized accept the Park Property and the Greenway Easement and to record executed versions of the documents attached as Exhibits A and B, respectively upon receipt from WP East Acquisitions, LLC.

SECTION 2: That the Metropolitan Mayor is hereby authorized to execute the Greenway Agreement between The Metropolitan Government of Nashville and Davidson County and WP East Acquisitions, LLC.

SECTION 3: That any amendments to the Agreement must be approved by Resolution of the Metropolitan Council.

SECTION 4: That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
