ORDINANCE NO. BL99-9

An ordinance to approve the granting of a permanent easement from The Metropolitan Government of Nashville and Davidson County, Tennessee, to the Tennessee Valley Authority for the location of overhead fiber optic lines on property owned by the Metropolitan Government (Tax Map 105-12, Parcel 50 - 501 Interstate Boulevard South).

WHEREAS, The Metropolitan Government of Nashville and Davidson County, owns certain property in Davidson County located on the south side of Herron Drive, east of Interstate Boulevard South (Tax Map 105-12, Parcel 50); and

WHEREAS, the Tennessee Valley Authority desires a permanent easement (as depicted on the attached Exhibit A) on a portion of said property for the purposes of installing and maintaining overhead fiber optic lines; and

WHEREAS, the Metropolitan Public School Board has determined that the granting of this easement would not adversely affect the usage of said property and the Director of Public Property Administration has determined the offer of $14,300 (fourteen thousand and three hundred dollars) as compensation for the easement to be fair and reasonable.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The granting of a permanent easement (as depicted on the attached Exhibit A) on Tax Map 105-12, Parcel 50, to the Tennessee Valley Authority is hereby approved.

SECTION 2. The Director of Public Property Administration, with the recommendation of the Metropolitan Public School Board, is hereby directed to grant said easement to the Tennessee Valley Authority and is authorized to execute the necessary documents pertaining thereto.

SECTION 3. The proceeds of fourteen thousand and three hundred dollars from the payment by the Tennessee Valley Authority for the easement shall be credited to the unappropriated fund balance of the debt service fund of the Metropolitan Board of Education.

SECTION 4. This Ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
