Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Pastor Chris Nichols of Crosspoint Church Bellevue Campus.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

Please find attached the State of Tennessee reporting forms required to be submitted to the local legislative body following the sale of bonds previously authorized by the Metropolitan Council. The reports are for the sale of $237,930,000 of Water and Sewer Revenue Bonds, Series 2013 which closed on April 25, 2013; and for $374,665,000 of General Obligation Improvement Bonds, Series 2013A which closed on May 9, 2013.

As always, we appreciate the Metropolitan Council’s support on these important financing initiatives.

- PROPOSED RULES AMENDMENT -

The following proposed amendment to the Rules of Procedure of the Metropolitan Council were distributed and will be considered at the next regular meeting of Council:

Rule 32 of the 2007-2011 Council Rules of Procedure is amended by deleting the first paragraph in its entirety and substituting with the following new paragraph:

“Members of the public may address the Council in a public hearing format regarding a specific resolution or ordinance when a public hearing is not otherwise required by law if the Council approves a motion by a two-thirds vote of the Council members present at such meeting to allow members of the public to address the Council at the next regular meeting regarding such ordinance or resolution. As a part of the authorizing motion, the Council shall set the time period for the public hearing and a time limit for individual speakers, as well as such other terms of the public hearing as it shall deem prudent.”

Action Commission
Reappointment of Ms. Kasey Anderson for a term expiring April 30, 2016. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Anthony Davis moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Airport Authority Commission
Appointment of Mr. Trey Harwell for a term expiring April 5, 2017. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Anthony Davis moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Human Relations Commission
Reappointment of Ms. Debra Palmer George for a term expiring April 18, 2016. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Anthony Davis moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Ms. Sharon Kay for a term expiring April 18, 2016. At the request on the nominee, the confirmation was deferred.

Appointment of Mr. Richard Kennedy for a term expiring April 18, 2016. At the request on the nominee, the confirmation was withdrawn.

Appointment of Ms. Tasha French Lemley for a term expiring April 18, 2016. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Anthony Davis moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Mr. Don Peterson for a term expiring April 18, 2016. At the request on the nominee, the confirmation was deferred.

- BILL ON PUBLIC HEARING & SECOND READING -

BILL NO. BL2013-431

A bill to be entitled: The Budget Ordinance of The Metropolitan Government of Nashville and Davidson County, Tennessee for Fiscal Year 2014. Mr. Matthews requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill citizens were in favor and in opposition to passage of the bill. The President declared the public hearing closed. The bill was approved by the Budget and Finance Committee. Mr. Matthews moved to pass the bill on second reading and re-refer the bill to the Budget and Finance Committee, which motion was seconded and adopted by a voice vote of the Council.

- CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2013-672

A resolution approving an agreement between the Metropolitan Government and the Convention Center Authority of Nashville and Davidson County for heating and cooling services at the Music City Center. The resolution was approved by the Budget and Finance and Convention, Tourism and Public Entertainment Facilities Committees.

RESOLUTION NO. RS2013-693

A resolution authorizing the Metropolitan Government of Nashville and Davidson County to enter into agreements with the cities of Belle Meade, Berry Hill, Goodlettsville, Forest Hills and Oak Hill with respect to the performance of municipal functions. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2013-694

A resolution appropriating up to $550,000 in Community Development Block Grant funds for Edmondson Park. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2013-695

A resolution approving an application for an Art Works grant from the National Endowment for the Arts to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Arts Commission. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2013-696

A resolution approving an application for a Community Corrections Services Grant from the State of Tennessee, Department of Correction, to The Metropolitan Government of Nashville and Davidson County, acting by and through the State Trial Courts, to divert felony offenders from the Tennessee prison system by providing community supervision and treatment services. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2013-697

A resolution accepting a grant from the United States Department of Justice to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department and the Davidson County Sheriff’s Office, for the purchase of bullet resistant vests. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2013-698

A resolution to approve the second amendment to the lease agreement between The Metropolitan Government of Nashville and Davidson County and Greensboro I, L.P., amending the rent and the utilities provisions for the Domestic Violence Program lease (Proposal No. 2011M-003PR-001). The resolution was approved by the Planning Commission, Budget and Finance, Public Safety- and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2013-699

A resolution accepting a grant from the Metropolitan Development and Housing Agency to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Historical Commission, to perform Section 106 environmental review necessary for development proposals using federal funds to determine potentially adverse effects to historic properties. The resolution was approved by the Budget and Finance and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2013-701

A resolution approving a contract by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and Matthews Memorial United Methodist Church to provide a location where current and potential Women Infants and Children (WIC) recipients may attend classes. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2013-702

A resolution accepting a Chronic Homeless Housing Initiative Grant from The Key Alliance to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Social Services Commission, to provide housing for Nashville’s chronically homeless populations. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2013-703

A resolution approving an amendment to the amended and restated lease agreement between the Metropolitan Government of Nashville and Davidson County, through its Parks and Recreation Board, and MFP Baseball, LLC. The resolution was approved by the Planning Commission , Budget and Finance, Parks, Library and Recreation and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2013-704

A resolution approving Amendment One (1) to a solid waste collection services contract between Red River Service Corporation, and The Metropolitan Government of Nashville and Davidson County, acting by and through its Department of Public Works, for a change to the pricing schedule, the renewal term, the vehicle age restriction, and the CPI adjustment. The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2013-705

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Vernice Bryan against the Metropolitan Government of Nashville and Davidson County in the amount of $38,936.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2013-706

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Ronald Flenoy against the Metropolitan Government of Nashville and Davidson County in the amount of $50,000.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2013-707

A resolution authorizing the Metropolitan Department of Law to compromise and settle the Metropolitan Government’s personal injury claim against Christina Yates. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2013-708

A resolution approving the election of certain Notaries Public for Davidson County. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2012-522

A resolution authorizing the Director of Public Property, or his designee, to exercise options to purchase real property (Map 150-00 Parcels 048.00 and 208.00) for the use and benefit of the Metropolitan Nashville Public Schools (Proposal No. 2012M-035PR-001). The resolution was approved by the Planning Commission; the Budget and Finance and Education Committees approved the resolution with an amendment; the Planning, Zoning and Historical Committee made no recommendation. Mr. Duvall moved to defer the resolution for two meetings, which motion was seconded and failed by a roll call vote. Mr. Duvall filed documents for the record. Mr. Duvall moved to defeat the resolution, which motion was seconded and failed by a roll call vote. Mr. Matthew offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. RESOLUTION NO. RS2013-670

A resolution establishing the certified tax rate in the General Services District, and declaring the amount of the certified rate for the Urban Services District, pursuant to the provision of Tennessee Code Annotated,§ 67-5-1701, et seq. The Budget and Finance Committee recommend deferment. Mr. Matthews moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2013-700

A resolution approving the Metropolitan Animal Care and Control fee schedule. The resolution was approved by the Health, Hospitals and Social Services Committee; the Budget and Finance Committee recommended deferment. Ms. Weiner moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2013-454

An ordinance approving the enrollment of the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department, in the CARFAX Investigative Data Sharing Program for access to motor vehicle accident reports in other jurisdictions. Upon motion duly seconded, the bill passed first reading and was referred to the Public Safety-Beer and Regulated Beverages Committee which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2013-455

An ordinance authorizing the Metropolitan Government to participate with Meharry Medical College to provide public improvements consisting of a water main and stormwater improvements for both Meharry’s proposed construction located on D.B.Todd Boulevard and Morena Street, as well as other existing properties in this area, Project No. 13-WL-0033. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2013-456

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to acquire permanent and temporary easements through negotiations or condemnation for the Due West Stormwater Improvement Project for 25 properties located along Barry Drive, Berkley Drive, Brink Haven Avenue, Coreland Drive, Due West Avenue and East Palestine Avenue (SW Project No. 12-SWC-0052 and Proposal No. 2012M-020ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Public Works and Planning, Zoning and Historical Committees which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2013-457

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to acquire permanent easements, temporary construction easements, or fee simple, through negotiations or condemnation for the Dodson Chapel Sewer Improvement Project for four properties located at 3590 Hermitage Industrial Drive, 5289 Old Hickory Boulevard, Hermitage Industrial Drive (unnumbered) and Dodson Chapel Drive (unnumbered) (Project No. 11-SC-0104 and Proposal No. 2013M-015ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Public Works and Planning, Zoning and Historical Committees which motion was seconded and adopted by a voice vote of the Council.

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent easements for the Retriever Court Stormwater Improvement Project for five properties located at 5913 and 5917 Retriever Court, 907 Retriever Place, 5960 Nolensville Pike and Hunters Branch Common Area (Project No. 03-D-0443 and Proposal No. 2013M-016ES-001). An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent easements for the Matthews Avenue Stormwater Improvement Project for 16 properties located along Matthews Avenue, Curdwood Boulevard and Virginia Avenue (Project No. 13-SWC-139 and Proposal No. 2013M-017ES-001). The bill was approved by the Planning Commission. An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent easements for the Appletree Road Stormwater Improvement Project for two properties located at 200 Appletree Road and 105 Edgebrook Road (SW Project No. 13-SWC-137 and Proposal No. 2013M-025ES-001). The bill was approved by the Planning Commission. BILL NO. BL2013-466

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Stacy Square Court Stormwater Improvement Project for eight properties located along Colt Road, New Sawyer Brown Road and Sawyer Brown Road (Project No. 13-SWC-138 and Proposal No.2013M-027ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Public Works and Planning, Zoning and Historical Committees which motion was seconded and adopted by a voice vote of the Council.

Without objection, the rules were suspended for consideration of one (1) late ordinance.

BILL NO. BL2013-467

An ordinance adopting the Capital Improvements Budget and Program 2013-2014 through 2018-2019 for The Metropolitan Government of Nashville and Davidson County as the official Capital Improvements Budget and Program of The Metropolitan Government of Nashville and Davidson County for Fiscal Year 2013-2014. The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Planning, Zoning and Historical Committees which motion was seconded and adopted by a voice vote of the Council.

- BILLS ON SECOND READING -

BILL NO. BL2012-291

An ordinance amending Sections 17.04.060 and 17.16.110 of the Metropolitan Code, Zoning Regulations, amending the definition of “recycling facility” to clarify that it does not include the conversion of material into a fuel product or asphalt, and to prohibit such activity on construction/demolition landfill property (Proposal No. 2012Z-022TX-001). The bill was disapproved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. Mr. Stanley moved to disapprove the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2013-360

An ordinance providing for a study of the compensation and benefits of elected officials of the Metropolitan Government. The bill was approved by the Budget and Finance and Personnel-Public Information-Human Resources-Housing Committees with an amendment. Mr. Banks offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Banks moved to pass the bill on second reading as amended, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2013-420

An ordinance amending Title 2 of the Metropolitan Code to create a small business economic development incentive grant program. The bill was approved by the Budget and Finance Committee. Mr. Maynard moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2013-421

An ordinance amending Section 10.56.250 of the Metropolitan Code with regard to open burning. The bill was approved by the Public Safety-Beer and Regulated Beverages Committee with an amendment. Mr. Pardue offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council, Mr. Pardue moved to pass the bill on second reading as amended, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2013-422

An ordinance amending Chapter 12.42 of the Metropolitan Code pertaining to the procedure to be followed in designating residential permit parking areas. The Traffic, Parking and Transportation Committee recommended indefinite deferment. Ms. Moore moved to defer the bill indefinitely, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2013-423

An ordinance approving an agreement between the Metropolitan Government and the State of Tennessee concerning the exchange of certain parcels of real property (Proposal Number 2013M-011PR-001). The Budget and Finance and Planning, Zoning and Historical Committees recommended deferment. Ms. Moore moved to defer the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2013-432

An ordinance establishing the tax levy in the general services district for the fiscal year 2013-2014, and declaring the amount required for the annual operating budget of the urban services district, pursuant to Section 6.07 of the Metropolitan Charter. The bill was approved by the Budget and Finance Committee. Mr. Matthews moved to pass the bill on second reading and re-refer the bill to the Budget and Finance Committee, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2013-434

An ordinance to approve an affiliation agreement by and between Vanderbilt University and The Metropolitan Government of Nashville and Davidson County to provide student clinical instruction and training with the Davidson County Drug Court. The bill was approved by the Public Safety-Beer and Regulated Beverages Committee. Ms. Weiner moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2013-435

An ordinance approving a lease agreement by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Public Education, and Liberty Collegiate Academy (Proposal No. 2013M-013PR-001). The bill was approved by the Planning Commission, Budget and Finance, Education and Planning, Zoning and Historical Committees.
