RESOLUTION NO. RS2013-705

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Vernice Bryan against the Metropolitan Government of Nashville and Davidson County in the amount of $38,936.00, and that said amount be paid out of the Self-Insured Liability Fund.

WHEREAS, on July 15, 2011, Vernice Bryan arrived at Belle Meade United Methodist Church to participate in the first day of early voting for the August 4, 2011 Metro General Election; and,

WHEREAS, while entering the poll booth, Ms. Bryan, who was 78 years old at the time, tripped over unsecured cables and wires running along the floor, causing her serious injuries; and,

WHEREAS, after investigation, the Metropolitan Department of Law believes the settlement amount as set forth in Section 1 is fair and reasonable and recommends that the claim be compromised and settled.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claim of Vernice Bryan for the sum of $38,936.00. This amount shall be paid out of the Self-Insured Liability Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
