ORDINANCE NO. BL2013-457

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to acquire permanent easements, temporary construction easements, or fee simple, through negotiations or condemnation for the Dodson Chapel Sewer Improvement Project for four properties located at 3590 Hermitage Industrial Drive, 5289 Old Hickory Boulevard, Hermitage Industrial Drive (unnumbered) and Dodson Chapel Drive (unnumbered) (Project No. 11-SC-0104 and Proposal No. 2013M-015ES-001).

WHEREAS, the negotiations or condemnation of permanent easements, temporary construction easements, or fee simple, for four properties located at 3590 Hermitage Industrial Drive, 5289 Old Hickory Boulevard, Hermitage Industrial Drive (unnumbered), and Dodson Chapel Drive, are needed to construct the Dodson Chapel Sewer Improvement Project No. 11-SC-0104; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2013M-015ES-001 on March 21, 2013, for the negotiations or condemnation of permanent easements, temporary construction easements, or fee simple.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to negotiate, condemn, or fee simple take permanent easements, temporary construction easements, or fee simple, for four properties located at 3590 Hermitage Industrial Drive, 5289 Old Hickory Boulevard, Hermitage Industrial Drive (unnumbered), and Dodson Chapel Drive (unnumbered) as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiations and condemnation authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
