ORDINANCE NO. BL2013-466

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Stacy Square Court Stormwater Improvement Project for eight properties located along Colt Road, New Sawyer Brown Road and Sawyer Brown Road (Project No. 13-SWC-138 and Proposal No.2013M-027ES-001).

WHEREAS, the negotiation and acceptance of permanent and temporary easements for properties located along Colt Road, New Sawyer Brown Road, and Sawyer Brown Road are needed to construct Stormwater Project 13-SWC-138; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2013M-027ES-001 on April 12, 2013, for the acceptance of permanent and temporary easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to negotiate and accept permanent and temporary easements for eight properties located along Colt Road, New Sawyer Brown Road, and Sawyer Brown Road as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiation and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
