RESOLUTION NO. RS2013-703

A resolution approving an amendment to the amended and restated lease agreement between the Metropolitan Government of Nashville and Davidson County, through its Parks and Recreation Board, and MFP Baseball, LLC.

WHEREAS, pursuant to Ordinance No. O98-1044, the Metropolitan Council approved an amended and restated lease (the “Lease”) between the Metropolitan Government of Nashville and Davidson County, through its Parks and Recreation Board, and MFP Baseball, LLC for the property commonly known as Greer Stadium; and,

WHEREAS, the parties previously amended the Lease by Resolutions RS2002-955 and RS2008-590; and,

WHEREAS, the parties desire to again amend the lease to extend its term and to amend specific expenditure reimbursement provisions; and,

WHEREAS, the citizens of Nashville and Davidson County will benefit from the approval of this amendment to the amended and restated lease agreement.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The proposed amendment to the amended and restated lease agreement between MFP Baseball, LLC and the Metropolitan Government of Nashville and Davidson County, through its Parks and Recreation Board, (Exhibit A) is hereby approved.

Section 2. This resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
