ORDINANCE NO. BL2013-421

An ordinance amending Section 10.56.250 of the Metropolitan Code with regard to open burning.

WHEREAS, Section 10.64.015(H) of the Metropolitan Code provides that the fire marshal shall determine when conditions are acceptable to allow open and recreational burning; and,

WHEREAS, the fire marshal has determined that certain types of open burning should require a permit from the fire marshal as well as the director of health, in order to increase the safety of the citizens of the Metropolitan Government of Nashville and Davidson County.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 10.56.250(A) of the Metropolitan Code is hereby amended by adding the phrase “with a valid permit from the fire marshal” after the word “duration.”

Section 2. That Section 10.56.250(E) of the Metropolitan Code is hereby amended by adding the phrase “and the fire marshal” after the word “director.”

Section 3. That Section 10.56.250(F) of the Metropolitan Code is hereby amended by adding the phrase “and with a valid permit from the director and the fire marshal” after the word “director.”

Section 4. That Section 10.56.250(G) is hereby deleted.

Section 5. Be it further enacted, that this ordinance shall take effect immediately after its passage.

Madam President:

I move to amend Ordinance No. BL2013-421 by deleting Section 3 in its entirety and substituting with the following new Section 3:

Section 3. That Section 10.56.250(F) of the Metropolitan Code is hereby amended by adding the phrase “and with a valid permit from the fire marshal” after the word “director.”
