ORDINANCE NO. BL2013-428

An ordinance approving the Metropolitan Government to abandon approximately one hundred fifteen (115) linear feet of an existing eight (8) inch public sewer main and easements and to accept approximately ninety-four (94) linear feet of an eight (8) inch public sewer main on property located at 1 Burton Hills Boulevard. (Proposal No. 2013M-009ES-001).

WHEREAS, the abandonment of the existing sewer line and easements and the acceptance of the new sewer line on property located at 1 Burton Hills Boulevard is needed to construct project number 12-SL-0097; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2013M-009ES-001 on March 18, 2013, for the abandonment and acceptance of said sewer lines and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government is authorized to abandon and accept public sewer mains and easements on the property located below and shown on Exhibit 1 which is attached hereto and incorporated by reference:

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4: This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
