ORDINANCE NO. BL2013-440

An ordinance approving the disposition of a portion of certain parcels of surplus property held by The Metropolitan Government of Nashville and Davidson County, listed as part of Davidson County Tax Map 92-14, Parcels 77, 78, and 86, by the Director of Public Property, to HCRI Tennessee Properties, LLC or an affiliate, thereof. (Proposal No. 2013M-010PR-001).

WHEREAS, The Metropolitan Government of Nashville and Davidson County is the owner of certain real property listed as Davidson County Tax Map 92-14, Parcels 77, 78, and 86 (see attached exhibit), adjacent to 28th Avenue North, Proposal No. 2012M-004PR-001; and,

WHEREAS, The Metropolitan Government acquired said parcels pursuant to BL2012-756, from LUI Nashville 28th Street II, LLC for the purpose of Project Number 10-R-1, 28th Avenue/31st Avenue Connector; and,

WHEREAS, all construction for said project has been completed; and,

WHEREAS, in accordance with BL2012-119, land use restrictions are now in force and affecting these same parcels 77, 78, and 86; and,

WHEREAS, The Metropolitan Government has determined the remaining portions of said parcels of property are no longer needed for governmental purposes; and,

WHEREAS, HCRI Tennessee Properties, LLC or an affiliate, thereof, agrees to purchase said surplus property, excepting those easements which are to be retained, as described in the attached exhibit.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVISON COUNTY:

Section 1. That a portion of the parcels listed as part of Davidson County Tax Map 92-14, Parcels 77, 78, and 86, which is further described in the attached exhibit, and is owned in fee by the Metropolitan Government, is surplus.

Section 2. The Director of Public Property is hereby authorized and directed to sell said property listed above in accordance with the Standard Rules and Regulations for the disposition of surplus real property for the highest and best prices.

Section 3. That the Metropolitan Government shall retain certain easements located on said property, as further described in the attached exhibit.

Section 4. The proceeds from the sale of said parcels of property shall be credited to the General Fund.

Section 5. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Madam President:
I move to amend Ordinance No. BL2013-440 by deleting the phrase “to the General Fund,” wherein it appears in Section 4, and substituting with the phrase “to 40011 – FY 11 Capital Projects Fund.”
