ORDINANCE NO. BL2013-455

An ordinance authorizing the Metropolitan Government to participate with Meharry Medical College to provide public improvements consisting of a water main and stormwater improvements for both Meharry’s proposed construction located on D.B.Todd Boulevard and Morena Street, as well as other existing properties in this area, Project No. 13-WL-0033.

WHEREAS, pursuant to the terms of the document, attached as Exhibit A, the Metropolitan Government of Nashville and Davidson County (the “Metropolitan Government”) proposes to improve water service by constructing approximately 1,200 L.F. of 12” , 225 feet of 8” and 50 feet of 6” public water main complete with all appurtenances, extending along D.B. Todd Boulevard and Morena Street, and to make stormwater improvements consisting of construction of approximately 400 feet of 18” storm drain and 350 feet of 24” storm drain complete with all appurtenances extending along Hermosa and Albion Streets (collectively, “the Project”), No. 13-WL-0033; and,

WHEREAS, the Project is deemed to benefit both parties and the general community, and the Metropolitan Government agrees to pay an amount not to exceed the lesser of Seven Hundred Thousand Dollars ($700,000) or seventy percent (70%) of the actual costs of the Project.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The participation agreement (Exhibit A) between the Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, and Meharry Medical College to improve public water and stormwater services in Davidson County, Tennessee, attached hereto and incorporated herein, is hereby approved, and the Director of Water and Sewer Services is authorized to execute the same.

Section 2. That the Seven Hundred Thousand Dollars ($700,000) from Metropolitan Government is available in Fund No. 47410 to pay the lesser of seventy percent (70%) of the actual Project costs or Seven Hundred Thousand Dollars ($700,000) as a contribution toward the Project.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
