RESOLUTION NO. RS2013-704

A resolution approving Amendment One (1) to a solid waste collection services contract between Red River Service Corporation, and The Metropolitan Government of Nashville and Davidson County, acting by and through its Department of Public Works, for a change to the pricing schedule, the renewal term, the vehicle age restriction, and the CPI adjustment.

WHEREAS, Red River Services Corporation provides certain collection services for solid waste to Metro as set forth in the Contract to Provide Collection Services for Solid Waste dated July 27, 2004 (“Contract”); and,

WHEREAS, the parties desire to amend the Contract in order to (i) reduce the curbside unit price for the semi and fully automated services; (ii) extend the term of the Contract by Metro’s exercise of the first and second renewal options granted in the Contract; (iii) provide Red River Services Corporation the ability to exercise discretion in the repair and replacement of its Service Vehicles; and (iv) delete the waiver of the CPI adjustment for a one year time period.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Amendment One (1) to the Contract to Provide Collection Services for Solid Waste, a copy of which is attached hereto and incorporated herein, by and between Red River Service Corporation and The Metropolitan Government of Nashville and Davidson County, acting by and through its Department of Public Works, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
