ORDINANCE NO. BL2013-425

An ordinance approving a license agreement to use Metro property for cross access by HHKW Properties, LLC (Proposal No. 2013M-009PR-001).

WHEREAS, HHKW Properties, LLC owns property at 801 & 811 Cowan Street; and

WHEREAS, The Metropolitan Government of Nashville & Davidson County owns property at 805 Cowan Street; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County has agreed to license, pursuant to the terms of the agreement attached hereto as Exhibit A, to HHKW Properties, LLC, acting by and through the Department of Water and Sewerage Services, a portion of that property known as 805 Cowan Street and as described in Exhibit A to construct a cross access driveway; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this license agreement be approved.

NOW, THEREFORE BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The license agreement between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee, Department of Transportation, attached hereto and incorporated herein as Exhibit A, is hereby approved, and the Metropolitan Mayor is authorized to execute said agreement.

Section 2. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Madam President:

I move to amend Ordinance No. BL2013-425 by deleting the phrase “the State of Tennessee, Department of Transportation,” wherein it appears in Section 1, and substituting with the phrase “HHKW Properties, LLC.”
