ORDINANCE NO. BL2013-423

An ordinance approving an agreement between the Metropolitan Government and the State of Tennessee concerning the exchange of certain parcels of real property (Proposal Number 2013M-011PR-001).

WHEREAS, the Metropolitan Government owns a parcel of real property of approximately 0.38 acres (the “Metro Property”) located at Eighth Avenue and Union Street and the building constructed thereon formerly known as the Ben West Library; and,

WHEREAS, the State of Tennessee owns a parcel of property of approximately 220 acres (the “TPS Property”) located at 1200 Foster Avenue and known as the Tennessee Preparatory School campus; and,

WHEREAS, pursuant to the terms of the document attached to this ordinance as Exhibit A, the Metropolitan Government proposes to replace the existing building on the Metro Property with a parking lot and convey the Metro Property to the State of Tennessee in exchange for the State of Tennessee’s conveyance to the Metropolitan Government of approximately 28 acres of the TPS Property and the buildings and other improvements thereon.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The document attached as Exhibit A to this ordinance is hereby approved, and the Metropolitan Mayor or his designee is authorized to execute it on behalf of the Metropolitan Government.

Section 2. The Metropolitan Mayor or his designee is further authorized to execute the quitclaim deed referenced in Exhibit A and such other documents as are customary and necessary to effect the transactions contemplated therein.

Section 3. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
