ORDINANCE NO. BL2013-443

An ordinance approving The Metropolitan Government of Nashville and Davidson County negotiating and accepting permanent easements for the Bell Crest Drive Stormwater Improvements for four properties located at 574 and 592 Bell Road and 5300 and 5304 Bell Crest Drive (SW Project 13-SWC-087 and Proposal No. 2013M-013ES-001).

WHEREAS, the negotiations and acceptance of permanent easements for four properties located at 574 and 592 Bell Road and 5300 and 5304 Bell Crest Drive are needed to construct Stormwater Project 13-SWC-087; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2013M-013ES-001 on March 18, 2013, for the negotiation and acceptance of permanent easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to negotiate and accept permanent easements for four properties located along at 574 and 592 Bell Road and 5300 and 5304 Bell Crest Drive as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiation and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4: This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
