ORDINANCE NO. BL2013-459

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent easements for the Matthews Avenue Stormwater Improvement Project for 16 properties located along Matthews Avenue, Curdwood Boulevard and Virginia Avenue (Project No. 13-SWC-139 and Proposal No. 2013M-017ES-001).

WHEREAS, the negotiation and acceptance of easements for 16 properties located along Matthews Avenue, Curdwood Boulevard, and Virginia Avenue are needed to construct Stormwater Project 13-SWC-139; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2013M-017ES-001 on April 4, 2013, for the negotiation and acceptance of permanent easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to negotiate and accept permanent easements for 16 properties located along Matthews Avenue, Curdwood Boulevard, and Virginia Avenue, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiation and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
