ORDINANCE NO. BL2013-442

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent easements for the Haynes Park Stormwater Improvement Project for 18 properties located along Boyce Court, Charles Court, Haynes Park Drive, and Kingview Drive (SW Project 12-SWC-174 and Proposal No. 2012M-016ES-001), and for the Maynor Place Stormwater Improvement Project for 23 properties located along Iverson Avenue and Maynor Avenue (SW Project 12-SWC-131 and Proposal No. 2013M-010ES-001).

WHEREAS, the negotiations and acceptance of permanent easements for 18 properties located along Boyce Court, Charles Court, Haynes Park Drive and Kingview Drive and 23 properties located along Iverson Avenue and Maynor Avenue are needed to construct Stormwater Projects 12-SWC-174 and 12-SWC-131; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2012M-016ES-001 for the Haynes Park project on June 6, 2012, and the mandatory referral No. 2013M-010ES-001for the Maynor Place project on March 19, 2013, for the negotiation and acceptance of permanent easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to negotiate and accept permanent easements for 18 properties located along Boyce Court, Charles Court, Haynes Park Drive and Kingview Drive, and 23 properties located along Iverson Avenue and Maynor Avenue as shown on Exhibits 1 – 4, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiation and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4: This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
