ORDINANCE NO. BL2013-445

An ordinance approving The Metropolitan Government of Nashville and Davidson County to abandon approximately 65 linear feet of an existing eight inch sanitary sewer main and easements and to accept one new sanitary sewer manhole on properties located at 4001 and 4003 Clarksville Pike (MWS Project No. 13-SL-0014 and Proposal No. 2013M-014ES-001).

WHEREAS, the abandonment of the existing sewer main and easements and acceptance of a sanitary sewer manhole on properties located at 4001 and 4003 Clarksville Pike are needed to construct project number 13-SL-0014; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2013M-014ES-001 on March 21, 2013, for the abandonment of said sewer main and easements and acceptance of a sanitary sewer manhole.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon the public sewer main and easements and accept a sanitary sewer manhole on the property located below and shown on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4: This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
