ORDINANCE NO. BL2013-435

An ordinance approving a Lease Agreement by and between the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Public Education, and Liberty Collegiate Academy (Proposal No. 2013M-013PR-001).

WHEREAS, Liberty Collegiate Academy desires to lease from the Metropolitan Board of Public Education the real property commonly known as Old Jere Baxter School located at 3515 Gallatin Road, Nashville, Tennessee 37216, for use as a charter school; and,

WHEREAS, the Metropolitan Board of Public Education desires to lease the property to Liberty Collegiate Academy for the desired use, such use being in the best interest of the public school system and the community which the school system serves; and,

WHEREAS, the Old Jere Baxter School is not needed at the present time for use by the Metropolitan Board of Public Education, but may be used at a later time.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The lease agreement by and between the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Board of Education, and Liberty Collegiate Academy, which is attached hereto and incorporated by reference, is hereby approved.

Section 2. Any amendment, change, or extension to the lease shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
