ORDINANCE NO. BL2013-456

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to acquire permanent and temporary easements through negotiations or condemnation for the Due West Stormwater Improvement Project for 25 properties located along Barry Drive, Berkley Drive, Brink Haven Avenue, Coreland Drive, Due West Avenue and East Palestine Avenue (SW Project No. 12-SWC-0052 and Proposal No. 2012M-020ES-001).

WHEREAS, the negotiations for or condemnation of permanent or temporary easements for 25 properties located along Barry Drive, Berkley Drive, Brink Haven Avenue, Coreland Drive, Due West Avenue, and E. Palestine Avenue are needed to construct SW Project Number 12-SWC-0052; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2012M-020ES-001 on June 12, 2012, for the negotiations or condemnation of permanent and temporary easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to negotiate or condemn permanent and temporary easements for 25 properties located along Barry Drive, Berkley Drive, Brink Haven Avenue, Coreland Drive, Due West Avenue, and E. Palestine Avenue as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiations or condemnation authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
