Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 7:00 p.m. in Metro City Hall.

The invocation was offered by Councilmember Pam Murray.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Dozier, Tucker, Briley, Dread, Gilmore, Isabel, Craddock, Murray, Jameson, Cole, Hart, Forkum, Ryman, Brown, Gotto, Burch, White, Loring, McClendon, Greer, Wallace, Walls, Whitmore, Crafton, Summers, Shulman, Adkins, Foster, Alexander, Wilhoite, Toler, Coleman, Bradley, Williams, Tygard and President Gentry (36); Absent: Neighbors, Hausser, Kerstetter (3).

The Minutes of the meeting of September 20, 2005 were corrected to state that Bill No. BL2005-732 was deferred to the second meeting in October.

The Rules-Confirmations-Public Elections Committee recommended approval of the following proposed amendment to Rule No. 37 of the Rules of Procedure of the Metropolitan Council, as amended:

By adding before the phrase "and on all legislation vetoed by the Mayor" the following language:

"on all budget ordinances, on all ordinances establishing the tax levy in the General
Services District for a fiscal year and declaring the amount required for the annual
operating budget of the Urban Services District."

- ELECTIONS -

Industrial Development Board

The President called for an election to fill three six-year terms on The Industrial Development Board of The Metropolitan Government of Nashville and Davidson County. Nominations previously made were: Mr. Nathanial Harris, Ms. Anedra Henley, Ms. Nettie Scalf and Col. (Ret.) Robert Whitworth. Mr. Adkins reported that the Rules-Confirmations-Public Elections Committee had interviewed Ms. Scalf and Col. Whitworth and found both qualified to serve. Mr. Harris and Ms. Henley were not present, and those nominations were deemed withdrawn. Mr. Wallace moved to elect Ms. Scalf and Col. Whitworth by acclamation, which motion was seconded and adopted by a unanimous vote of the Council. The President declared that Ms. Scalf and Col. Whitworth were elected to six-year terms on the Industrial Development Board.

Mr. Wallace moved to re-nominate Ms. Anedra Henley to fill the remaining vacancy. There being no further nominations, the nomination was referred to the Rules-Confirmations-Public Elections Committee for a recommendation, and an election will be conducted at the next regular meeting of the Council.

SUBSTITUTE RESOLUTION NO. RS2005-927

A resolution establishing a Task Force on Telecommunications Innovation to explore and report on the feasibility of using Metropolitan Government resources in a network that is available to the public using broadband technologies, broadband over power lines, Wi-Fi, Wi-Max, and other wireless applications, end-user fiber build out, and other telecommunications technologies. The resolution was approved by the Budget and Finance Committee. A resolution approving an amendment to a grant from the Greater Nashville Regional Council to The Metropolitan Government of Nashville and Davidson County by and through the Metropolitan Social Services Commission to provide personal care, homemaker, meal delivery, and caregiver support services. The Budget and Finance and Health, Hospitals and Social Services Committees recommended deferment. Mr. Cole moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2005-989

A resolution appropriating Seventy-Five Thousand Dollars ($75,000) from the Unappropriated Fund Balance of the General Services District to fund a Best Practices Study for the Metropolitan Council. The Budget and Finance Committee recommended deferment. Mr. Wallace moved to defer the resolution to the second meeting in December, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2005-997

A resolution electing three members to the Board of Directors of the Industrial Development Board of The Metropolitan Government of Nashville and Davidson County. Mr. Loring offered a substitute resolution and moved that it be accepted for filing, which motion was seconded and adopted without objection.

RESOLUTION NO. RS2005-999

A resolution approving a contract by and between Foundations Associates, Inc., and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to provide residential treatment services and half-way house placement to homeless persons with co-occurring disorders of mental illness and chemical dependency. The resolution was approved by the Budget and Finance Committee; the Health, Hospitals and Social Services Committee recommended deferment. Mr. Walls moved to defer the resolution to the second meeting in November, which motion was seconded and adopted by a voice vote of the Council.

A resolution accepting a grant from the State of Tennessee to The Metropolitan Government of Nashville and Davidson County for the State Trial Courts' residential drug court program. Mr. Jameson requested a suspension of the rules for consideration of a late resolution. Mr. White objected and the rules were not suspended.

An ordinance amending Chapter 16 of the Metropolitan Code of Laws by adopting a later edition of the National Electrical Code and amendments thereto, and adopting a later edition of the American National Standard Code of Accessible and Useable Buildings and Facilities, with certain amendments thereto. Upon motion duly seconded, the bill passed first reading and was referred to the Codes, Fair and Farmers Market Committee by a voice vote of the Council.

BILL NO. BL2005-797

An ordinance approving the Jefferson Street Redevelopment Plan. Upon motion duly seconded, the bill passed first reading and was referred to the Federal Grants Review Committee by a voice vote of the Council.

BILL NO. BL2005-798

An ordinance approving Amendment No. 3 to the Phillips-Jackson Street Redevelopment Plan. Upon motion duly seconded, the bill passed first reading and was referred to the Federal Grants Review Committee by a voice vote of the Council.

BILL NO. BL2005-799

An ordinance authorizing the acquisition of property by negotiation or condemnation for use in a public project for The Metropolitan Government of Nashville and Davidson County and specifically with relation to the construction of a new Fire Station in the Neely's Bend Road area (Proposal No. 2005M-174G-04). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Budget and Finance, Public Safety-Beer and Regulated Beverages and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2005-800

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to RS10 district a portion of properties located at 5791 Cane Ridge Road and Cane Ridge Road (unnumbered) (57.95 acres), all of which is described herein (Proposal No. 2005Z-066G-12). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2005-801

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by canceling a commercial Planned Unit Development district, located at 5007 Gallatin Pike, south of Briley Parkway (4.73 acres), approved for a 5,200 square foot museum, and a 1,000 square foot souvenir shop, all of which is described herein (Proposal No. 121-80-U-05). An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by canceling a Planned Unit Development district, located at Joyce Lane (unnumbered), south of Briley Parkway (9.79 acres), approved for 96 condominium units, all of which is described herein (Proposal No. 106-80-U-05).
